Terms of Service

1. Who we are and acceptance of these Terms

Track Cruises (track.cruises) is operated by Serghei Culesov, impresa individuale, Via Angelo Scarsellini 32, 37123 Verona (VR), Italia, VAT number (Partita IVA) 01696350550 (“we”, “us”). These Terms govern your use of the website and its features (the “Service”). By using the Service you accept them; if you do not agree, please do not use it.

Our Cruise Pricing API is covered by separate API Terms of Service.

2. What the Service does

Track Cruises collects publicly available cruise prices from several cruise lines and markets and helps you compare them. The Service offers:

• Current cruise prices and price history
• Price drop alerts
• Itinerary maps
• Favourites and watchlists
• Email notifications about price changes and deals
• Cruise line information and comparison tools

We are not a travel agency and do not sell cruises. You book directly with the cruise line or travel seller, on its terms.

3. Accounts

Some features require an account. You must be at least 16 to create one. You are responsible for:

• keeping your login details confidential;
• everything that happens under your account;
• giving accurate, complete information and keeping it up to date;
• telling us immediately about any unauthorised use of your account.

4. Acceptable use

You may use the Service only for lawful purposes and in line with these Terms. In particular, you may not:

• try to access our systems or other users’ accounts without authorisation;
• interfere with or disrupt the Service or the servers connected to it;
• use bots, scrapers or other automated means to extract data from the website (our API exists for that);
• resell or republish data from the Service without our written consent;
• transmit viruses, malware or other harmful code;
• harass, abuse or harm other users;
• break any applicable law.

5. Accuracy of the data

Prices: we work to show accurate, up-to-date prices, but cruise prices change without notice and we cannot guarantee that the prices shown are accurate, complete or current.

Third-party information: the Service relies on information from cruise lines and other third parties, whose accuracy we cannot guarantee.

Availability: cruise availability can change. Always check the price and conditions with the cruise line or seller before you book.

6. Price alerts

Price alerts are a convenience. By setting them up, you understand that:

• they are based on the information available to us when we check;
• we cannot guarantee an alert for every price change;
• how often and when alerts are sent depends on our data refresh schedule;
• you can change or delete them at any time in your account.

We are not responsible for missed opportunities or losses caused by delayed or missed alerts, except where the law does not allow this limitation.

7. Subscriptions

Some features require a paid plan. Plans and prices are shown on our Pricing page. Orders are handled by our reseller FastSpring (Bright Market LLC), which acts as merchant of record: FastSpring sells you the subscription, charges your payment method and issues your invoice, under its own terms shown at checkout.

• Subscriptions renew automatically at the end of each billing period until you cancel.
• You can cancel at any time; your access continues until the end of the period you have paid for.
• If we change the price of a plan, we will tell you before your next renewal, and you can cancel before the new price applies.
• FastSpring calculates any applicable taxes based on your billing country.

8. Cancellation and refunds

Cancellation: go to Dashboard → Profile → Subscription. Cancellation takes effect at the end of the current billing period.

14-day money-back guarantee: if you are not satisfied, write to support@track.cruises within 14 days of your first purchase and you will get a full refund to your original payment method, normally within 5–10 business days. After 14 days, the current billing period is not refunded.

This guarantee is in addition to any rights you have under consumer law, including the right of withdrawal where it applies, and does not limit them.

9. Intellectual property

The Service, its software, design and texts belong to us or our licensors and are protected by copyright and other intellectual property laws. Cruise line and ship names are trademarks of their respective owners.

You may not copy, republish or redistribute content from the Service beyond personal, non-commercial use without our written consent.

10. Privacy

How we handle personal data is explained in our Privacy Policy.

11. Liability

The Service is a tool to help you compare prices. We take care to keep it accurate and available, but we cannot guarantee that it is error-free or uninterrupted.

We are not liable for indirect or consequential losses, such as missed bookings or lost savings, arising from the use of or inability to use the Service, nor for the conduct or websites of third parties.

For business users, our total liability is limited to the amount paid to us in the twelve months before the claim.

Nothing in these Terms limits liability for wilful misconduct or gross negligence (Art. 1229 Italian Civil Code), for death or personal injury, or any liability or consumer right that cannot be excluded or limited by law.

12. Indemnification

If you use the Service for business purposes, you will indemnify us against third-party claims arising from your breach of these Terms.

13. Third-party links, advertising and affiliate compensation

The Service contains links to third-party websites and services that we do not own or control, and we are not responsible for their content, privacy policies or practices.

Advertising and affiliate compensation. Some pages carry paid advertising from CruiseDirect, served through the CJ Affiliate network. These placements are labelled “Advertisement”, and we may receive a commission if you make a booking after clicking one. This costs you nothing extra.

Advertising does not influence our data. Which market we show as cheapest, how cruises are ranked, filtered or alerted on, and the prices we display come solely from the pricing we collect from cruise operators. No advertiser pays for placement in those results, and we receive no commission on bookings you make through our direct links to a cruise line’s own website: there you buy from the operator at its standard price and we are not a party to the transaction.

We are not responsible for content, goods or services offered on third-party websites.

14. Availability and changes to the Service

We work to keep the Service available, but it may be interrupted for maintenance or by events beyond our control. We may change, add or remove features. If we discontinue a paid plan, we will give you reasonable notice and you keep access until the end of the period you have paid for.

15. Closing your account

You can stop using the Service at any time and ask us to delete your account by writing to support@track.cruises. We may suspend or close an account that breaches these Terms or is used fraudulently; where reasonable, we will warn you first and explain why.

16. Governing law and disputes

These Terms are governed by Italian law. If you use the Service as a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside.

If you are a consumer, you may bring proceedings before the courts of the place where you live; consumers resident in Italy can always rely on the court of their place of residence or domicile (Art. 66-bis of the Italian Consumer Code). If you use the Service for business purposes, the courts of Verona, Italy, have exclusive jurisdiction.

17. Changes to these Terms

We may update these Terms. We will tell you about material changes by email or on the site at least 30 days before they take effect. If you do not agree, you can cancel your subscription and stop using the Service before then; if you keep using it afterwards, the new Terms apply.

18. Severability

If any provision of these Terms is found invalid, the remaining provisions stay in force.
